General Conditions 1: Scope The www.cosmicconnexion.com website is designed to enable the public to interactively contribute, by sending messages such as those defined below, to the production of an audiovisual film provisionally entitled “COSMIC CONNEXION”, produced by CARGO FILMS S.A. and co-produced by ARTE France (hereinafter jointly called the “Companies”), a 160 minute documentary directed by Marie Cuisset and Anne Jaffrennou, which is to be broadcast on ARTE (hereinafter called “the audiovisual programme”). Internet surfers can contribute under the following conditions: all contributions must follow the instructions given on the home page of the said website; contributions can be in the form of messages consisting of text, images and sound; contributions must be sent by the participants either: * by email to the following address: www.cosmicconnexion.com * by post to the following address: COSMICCONNEXION BP 30278 75424 Paris Cedex 09 France each participant must indicate his/her family name and first name, postal address and email address, the latter only being required if the contribution is sent by email; in the absence of the above information, the contribution will not be accepted; contributions must be received by 31th of august 2006 at the latest, after which they will no longer be accepted. The Companies may publish the above-mentioned contributions sent by Internet surfers on www.cosmicconnexion.com. The Companies may then incorporate the said contributions in the Audiovisual Programme. It is understood that the selection of contributions to be published on the website and/or incorporated in the Audiovisual Programme shall be at the sole discretion of the Companies. 2: Authorisation All the participants expressly authorise CARGO FILMS S.A. and ARTE France to use all and/or part of their contribution(s), worldwide and, more generally speaking, universe-wide, free of charge, in their original form, or in the form of extracts, whether they are incorporated in the Audiovisual Programme or not, on any medium and under any format, and by any manner or process known or unknown at the present, for the legal period of copyright in France, both now and in the future. The participant therefore grants the Companies: the right to reproduce all or part of his/her contribution, using any technical process whatsoever, by authorising the reproduction of as many copies as required, under any form or language and on any medium whatsoever, whether digital or analog. This right includes the right to digitise, modulate, compress and decompress the contribution for the purposes of archiving, storage, transfer and/or communication thereof and/or the right to use any other system to save the data and documents recorded or copied, and make any appropriate modifications inherent to technical and artistic requirements, for its possible incorporation in the Audiovisual Programme. The right of performance which includes the right of public or private communication of all or part of the contribution, by any process, on any medium, in any format, whether digital or analog, in any language, and by any means, including television broadcasting by land radio, cable and/or wire and satellite on any receiver and via the Internet, in both commercial and non-commercial sectors, in view of collective or individual reception. The right to use all or part of his/her contribution, for any promotional operations relating to the Audiovisual Programme, and more generally speaking, to ARTE, by any means (television broadcasting, Internet, etc.) and on any medium whatsoever. The Companies may use the rights granted to them above in application of these general conditions either directly or through any third parties to whom they may assign the necessary rights, by transfer thereof if so required. 3: Guarantees provided by the participant 3-1. The participant expressly declares that he/she is the personal author of the contribution and shall refrain from introducing any element that may be likely to breach the intellectual property rights of any other party. 3-2. In this respect, he/she warrants the Companies against any claims or actions that may be made or instigated against them for any reason whatsoever as a result of using the contribution, by any persons who may claim rights to any or all of the said contribution. 3-3 The participant alone is fully responsible for the content of his/her contribution; in this respect, he/she shall refrain from using any element of any kind that could breach the personality rights of any third parties, and declares that he/she has obtained the prior authorisation of any other person whose image, name or voice may appear in the said contribution. The participant expressly warrants the Companies against any claims on the part of any third parties in this respect. 3-4 He/she shall respect all current legislation, and in particular, he/she shall not send any contributions of a pornographic, paedophile, hateful, injurious or defamatory character or, generally speaking, which could be contrary to law and order or accepted standards of behaviour; likewise, any contributions with advertising content are prohibited. 3-5 The Companies reserve the right to delete or refuse to publish any message which is contrary to the above-mentioned provisions and/or whose content does not have any relationship with the editorial line of the audiovisual programme envisaged. 3- 6 If the participant is guilty of a breach of legislation or the rights of any third parties, the Companies reserve the right to provide information to any legitimate authority which could allow or facilitate identification of the said participant, at the request of a legitimate authority (court of law, administrative authority, police department), such as the IP address and connection time if such information is still in its possession. 4 – Use of data collected The personal data recorded on the website server and supplied by the participant of his/her own volition shall be used to identify the said participant, in order to inform him/her that his/her contribution has been selected for the requirements of the Audiovisual Programme, where applicable, and are strictly reserved for internal use only. Access to data collected In accordance with French Law n° 78-17 of January 6th, 1978, amended by the law of August 6th, 2004, on Data Processing, Data Files and Individual Liberties, any private individual or corporate body has the right to access, correct, rectify and delete any data concerning them. All requests must be sent to the following address: contact@cosmicconnexion.com 5. Miscellaneous These general conditions are governed by French law. Any dispute as to the interpretation or performance of the said general conditions will be submitted to the competent Paris courts, to which the parties hereby accord sole jurisdiction. These general conditions have also been drafted in English and German. In the event of a contradiction between any of the three versions, the French version shall take precedence. If any of the provisions in these general conditions should be null and void in the eyes of the law, it will be deemed not to be written, and the other provisions of the said general conditions shall remain fully applicable. 6. Acceptance of general conditions The participant hereby declares that he/she has full knowledge of these general conditions, and accepts them unreservedly.
